Weekly Legislative Bulletin

Hotlist 3/08/2011

One awful bill that should be on the House floor this week is Senate Bill 22, APA Rules: Limit Additional Costs. We ask you to OPPOSE this bill because it is detrimental to North Carolina’s people, economy, and our environment. Rest assured, this bill will be scored on our annual scorecard.

Dear Friends,

On this date in 1971 Muhammad Ali fought Joe Frazier in the “Fight of the Century” at Madison Square Garden. It was the first of three fights for the two. On all accounts the fight lived up to the hype: Frazier knocked down Ali for the first time in his career in the 15th round. Ali got up, but Frazier ultimately won the fight by unanimous decision.

A boxing analogy seems about right for what is going in the General Assembly. There are lots of bills moving fast with little time for debate, and folks are trying to land any blow they can to slow them down and make the bills more tolerable to their cause.

Rules protect people --and help stop irresponsible businesses from doing things that hurt people in the name of profit. Having fewer rules that protect our land, water, and air ultimately damages our communities, our citizens, and the businesses that choose to come here in large part because of our high quality of life. This is bad policy disguised as ‘reducing burdens on business.’ What it does is potentially allow businesses from being good corporate citizens and avoid taking responsibility for their actions.

Please read this letter from Administrative Law Professors on Senate Bill 22 that explains some additional pitfalls of this legislation, and the fact that it is ultimately unnecessary given our current process.

Cheers,

Dan
