Judicial Watch: Stopping GenX Emissions

Cape Fear River Watch has sued to force the immediate cessation of all GenX emissions from the Chemours plant near Fayetteville.

The group acted through the Southern Environmental Law Center (SELC) after the N.C. Department of Environmental Quality (DEQ) declined its request to issue the ruling. SELC argues in its filing that DEQ has the authority and obligation to order Chemours to immediately halt all releases, because the company’s ongoing contamination of air and water is causing imminent danger to people’s health and public safety.

Chemours argues that it cannot meet the 100% reduction demand, but that it has substantially reduced emissions and is continuing to reduce them. The citizen groups argue that the complete cessation of emissions is required to address a public health emergency.
