Judicial Watch: DEQ Seeks Injunction Against GenX Discharges

The Chemours Corporation has been releasing the toxic chemical GenX at more than 40 times the rate previously admitted by the company, according to state court filings. The NC Department of Environmental Quality (DEQ) is seeking a court order to force the company to stop releasing the pollutant into our air and water.

In its case against Chemours, DEQ made new court fillings last week using some of the strongest language yet to portray the company’s misrepresentations about its pollution emissions. Chemours’ excessive air pollution emissions have been identified as the most likely source of widespread GenX groundwater contamination around the plant and as far southeast as Wilmington.

DEQ’s amended complaint against Chemours seeks to have the company required “to control air emissions of GenX compounds; remove, treat or control all other sources of GenX compounds; and provide a full accounting of any process wastewater discharge through a drainage ditch at the site.”

DEQ Secretary Michael Regan said in a statement, “It’s time for Chemours to own up to the level of contamination they have caused to the environment in and around their Fayetteville Works facility. DEQ is using every tool available to require Chemours to clean up and stop further GenX contamination.”
